Company Information and Background:

These Terms and Conditions are applicable to the parties’ obligations regarding the concerts, merchandise and other services (all referred to as the “Deliverables”).

Acceptance:

By purchasing tickets (directly or indirectly) via this website, you expressly agree: To be bound by these Terms and Conditions; That you have read, understand and accept the Terms and Conditions; Accept RETRO FAIR's reservation of its right to alter the Terms and Conditions at any time and that it is your responsibility to review any alterations to the Terms and Conditions each time you access the PRETORIA RETRO FAIR website; That all information regarding the event, merchandise and services or any other matters, is subject to change without notice.

Terms and Conditions of purchase of tickets:

PRETORIA RETRO FAIR shall not, in any circumstances, be liable for any loss of whatsoever nature which may be suffered as a result of the cancellation or postponement of the concert, as well as any last minute medical, logistical or other event that prevents you from attending the concert.

Admission and risk:

PRETORIA RETRO FAIR reserves the right of admission to the event and the venue during the fair and further reserves the right to alter the program at the event. You further confirm, by logging on to the PRETORIA RETRO FAIR website, that you will be assuming all risks associated with the use of the Internet, including any risk which may be posed to the hardware or software which you are using, or any data which you may have stored on your computer, being damaged by any virus which may be transmitted or activated via the PRETORIA RETRO FAIR website or your access to it.

Bookings:

Subject to availability and receipt of payment, bookings and orders will be processed immediately and confirmed by way of booking number via email firstly when the transaction takes place and secondly when the transaction is shown on PRETORIA RETRO FAIR statements.

Changes in bookings:

If you make changes to your booking after payment that may require a refund, a 10% administration fee will be charged.  If a refund is requested, it must be done in writing to info@retrofair.co.za and your banking details must accompany the communication.

Cancellations:

In the event that you should wish to cancel your booking in full, the following will apply. Until 1 day before PRETORIA RETRO FAIR – Refund will be 50% of amount paid. All cancellations that require a refund have to be submitted electronically to info@retrofair.co.za and accepted by Retro Fair via return email prior to cancellation, to apply as valid cancellation.

Sending of information:

Information transmitted through an unsecured link over the Internet, including e-mail, is subject to potential unlawful access or monitoring. The user accepts that PRETORIA RETRO FAIR cannot be held liable for any loss, or damage suffered by the user as a result of unlawful activities by unscrupulous persons, as PRETORIA RETRO FAIR cannot prevent such behaviour.

Nothing on this site should be construed as granting any licence or right to use any trademark without PRETORIA RETRO FAIR’s prior written permission and/or that of third parties, as the case may be. The user may not, without PRETORIA RETRO FAIR’s prior written consent, use PRETORIA RETRO FAIR’s intellectual property or that of third parties for any purposes whatsoever. “RETRO FAIR” as well as any stylised versions thereof are trademarks of PRETORIA RETRO FAIR. All rights are reserved in these trademarks. You hereby acknowledge PRETORIA RETRO FAIR’s trademarks as well as any other trademarks appearing on the website or on tickets sold through the website and ownership of the intellectual property therein of their respective owners. With regard to the venue for the event, PRETORIA RETRO FAIR acts strictly as an agent for At Your Place Catering. PRETORIA RETRO FAIR makes no representations whatsoever relating to the quality or capacity of the venue, or the facility or services at the venue.

Third party information:

PRETORIA RETRO FAIR may use the services of other third party organisations to provide information on this site. PRETORIA RETRO FAIR has no control over the third party information and makes no representations or warranties of any nature as to its accuracy, appropriateness or correctness. PRETORIA RETRO FAIR will not be directly or indirectly liable for any damages that may arise from the user’s reliance on it.

Warranties and representations:

All the information appearing on this site is provided without a representation or warranty whatsoever, whether expressed or implied, and PRETORIA RETRO FAIR disclaims any liability to the user in this regard. PRETORIA RETRO FAIR does not warrant that the site or online services will be error-free.

Disclaimer and limitation of liability:

PRETORIA RETRO FAIR shall not be liable for any injury, loss or damages, whether direct, indirect, special, incidental, or consequential whatsoever relating to your or your friend or family’s attendance of the event, participation in any event organised by PRETORIA RETRO FAIR during the PRETORIA RETRO FAIR day or related to any transaction between yourself and PRETORIA RETRO FAIR, whether such damages arose out of contract, or delict or otherwise and regardless of whether PRETORIA RETRO FAIR was expressly advised of the possibility of such injury, loss or damage in access of your booking fees. PRETORIA RETRO FAIR shall not be liable to any person for injury, loss or damage incurred as a result of reliance upon material contained on this website.

Acceptance of terms & conditions:

The content on the PRETORIA RETRO FAIR website, whether provided by PRETORIA RETRO FAIR or any third party, is provided for information purposes to the users of the PRETORIA RETRO FAIR website. By accepting the Terms and Conditions of Use of the PRETORIA RETRO FAIR website, you acknowledge that any reliance placed upon any of the content displayed on or distributed through the PRETORIA RETRO FAIR website is made at your own discretion and shall be at your own risk.

User’s liability to PRETORIA RETRO FAIR:

The user shall be liable to PRETORIA RETRO FAIR for any liabilities, losses or expenses incurred by PRETORIA RETRO FAIR as a result of any breach by the user of these terms and conditions. Customer privacy policy PRETORIA RETRO FAIR shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

Payment options accepted:

Payment may be made via online sales on the PRETORIA RETRO FAIR website or at the gate on the day of the event.

Country of domicile:

This website is governed by the laws of South Africa and PRETORIA RETRO FAIR chooses South Africa as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature. All disputes shall be referred to the Pretoria Magistrates Court for adjudication.

Acknowledgement of use of website as electronic contract:

By accepting the Terms and Conditions of this contract you expressly agree that the offer and acceptance pertaining to any transaction made by you on the PRETORIA RETRO FAIR website may be expressed electronically and such contract shall not be denied validity or enforceability on the sole grounds that it was affected via the web site. If any legal proceedings arising between yourself and PRETORIA RETRO FAIR or its agents, nothing in the application in the law of evidence shall apply so as to deny the admissibility of communication between yourself, PRETORIA RETRO FAIR and/or the agent, via the PRETORIA RETRO FAIR website, solely on the ground that such communication took place electronically or, if it is the best evidence that you could reasonably be expected to obtain, on the grounds that it is not in its original form.

Cessation of agreement:

If by reason of fire, earthquake, labour dispute or strike, act of God or public enemy, any municipal ordinance, any provincial or state law, government order or regulation, or any other cause beyond either party’s control of whatsoever nature, either of the parties are prevented from performing their obligations, then based on such impossibility of performance, all consideration will still be due and payment will only be refundable to the extent the PRETORIA RETRO FAIR has or will not incur expenses with regard to these obligations.
Interpret to comply with Law:
These Terms and Conditions will only apply as far as allowed by law. These Terms and Conditions must be interpreted so that they will not break the law and must be applied as far as the law allows.
Prohibited Items:
​We may prevent you from bringing particular items into the Stadium. You are also not allowed to bring any items into the Stadium which we reasonably considered to be unacceptable or inappropriate. Such items include, but are not limited to the following: alcohol, radios, bottles, tins, glasses, bugles, crackers, cooler boxes, firearms, knives, or any dangerous or hazardous objects. We may conduct reasonable examinations and searches to ensure compliance.
Prohibited behaviour:
​You are not allowed to behave in any way which is a nuisance, violent, abusive, disruptive, threatening, an infringement of somebody’s rights, or which we reasonably consider to be inappropriate or unacceptable.
The Company may use your image or likeness in any live or recorded video display, photograph or picture.
